Task 3
Describe
contractual, legal and ethical obligations in the television and film
industries, with some appropriate use of subject terminology.
Contractual
In the
television and film industry there are many different contracts available, such
as confidentiality and Exclusivity contracts. Confidentiality is a type of
project, which keeps projects and productions under construction from the
public. An example of this occurrence is star trek, this was film on a close
set where the characters appearance was hidden from the publics eye, they did
not allow cameras which meant no spoilers or photographs would be spilt online
or in the news. Exclusivity is another contract that has production companies
secure the rights on an idea that has been introduced to the film or TV show.
For example, inventing a new game which includes capturing criminal around the
world with an interesting background plot, which is then spoilt online but not
protected, where other gaming companies research and then make the game before
the other first gaming company who invented it and make the profit earnings and
sales. These two types of information can secure the release of your film or TV
show and stop others from making what is originally yours.
Legal
Legislation
is the terms and conditions of the employee right in the business or company or
production. Health and Safety is added to the contracts to make people aware of
what type of image that incidents could occur in the studio or film set. The
employee must sign the contract for his own awareness and health and safety
act. In the contract he signs that he cannot be discriminated against, sex,
race discrimination in the TV and Film industry and also the wage that he
receive which is equal to both genders. The healthy and safety act considers
(The Heath and Safety Act 1974) this covers to whole of Great Britain.
- Healthy and Safety
The
healthy and safety department have the work Act of 1974, which place the duty
of the employer, employees to work in a safe film, or TV set environment. For
example, working in areas where hazards and obligations are taking into
control, which has a safe response to you by keeping you away from such areas
of the building or danger zone.
- Health
and safety Advisors
Health
and safety advisors are the managers of each health and safety system in each
film or TV production. They have the responsibility of reviewing each Health
and Safety policy act in the prospects meaning they have to ensure everything
is up to date in the arranged places.
- Paramedics
and Paramedical Staff
Paramedics
or paramedical staff have to be professional at what they are doing, also have
some knowledge on working in the medical field with the film or creative media
industries, as injuries occur whilst filming and acting on stage.
- Unit
Nurse
Unit
Nurse is the first aid cover for the film or TV production.
Contract
Types For Workers Full time
A
contract that has an employee is an employee who works full time for example,
from 8 in the morning till 5 in the afternoon. They also have different hours
each week depending on what type of work is required.
Part
Time
A part
time employee is some one for example working on Saturdays and Sundays, as they
have no other available time to spare for work either because of other work or
education. The hours can be arranged at all time to match the employees and
business availability.
Permanent
Permanent
employees are employees who are set on required work for a number of hours a
week; this can range from 26-45 hours a week. For example, someone who hasn’t
got education in the way or any other distractions would cope these hours, as
they are usually free at this time of work period.
Shift
Work
Shift
pattern for employees are working a set of numbers during a day to day cover
for a 24 hour period, meaning you will be called early or late afternoon shift
to finish the Broadcasts on air. Which is mainly focused on the news channels.
Freelance
Free
lance is hiring yourself out to media companies and to do work for them, the
only physical action you have to do is find the media work to work in, this is
not a guaranteed income as it is not a fixed job. Working freelance could
improve and develop skills and your own free will and experience. This is a
work where there is no pay from company to company as it the capital is too
expensive to move about.
Voluntary
Voluntary
work is free work at your own will, this is mostly done to gain experience for
a better personal statement, this a work related job where you just help but
not get no income from it, which also has hours included for e.g. 9-5 in a
charity shop.
Temporary
Temporary
work is short term work, it can be a mix of both part time and full time work,
this all depends on set of number hours you can work per week and how many days
and hours you are available to work.
Ethical
Obligation
Ethical obligations are important in the film
and TV industries, for example, if there is a shooting scene In the film
making, the director has to authorize the police, that there is filming taking
place which are using fire arms, this Is called the code of practice, which
allows the film to take place. If the rules are not prohibited in the film then
the whole cast and film set is shut down. Furthermore, The British Board of
Film Classification which is a film regular based in Britain who watch the film
and give ratings for the type of classification age that is required to watch,
if it includes bad language, sex, violence and drug use then it has to be rated
18, other ratings such as cartoon or children film’s are rated U or PG, other
film also use bad language or violence but have a rating of 12,15 as it is not
so bad for the publics eye. The reason film have a separated film age content
is; it can reach a wider range of audience, children cry if they want
something, if the film has been notified to the BBFC and it was not the age range
the film wanted then they will edit bits and add content or possibly remove
some to match there targeted audience. For example, fast and furious has the
age range of 12A, they has passed the uncut to reach their targeted audience
which means not further editing is required to match their statistic age
requirement, meaning they are saving more money and time.
The below picture is statistics in the UK on how age
distribution across the uk film indrustry is working with film.
The
statistic shows 30-40 year olds buy more DVD’s then 16 – 60 year olds, this
means 18 and over film is buying and selling more in the UK film industry. The percentage shows 30-40 year old in 2009
were in an increase since 2010-11.
These
are examples of different aged film for different audiences;
This picture illustrates the age ratings for
each filmmaker to add into there film, this shows the guidance of what each
film required when watching, some need parent’s guidance and some only apply to
adults.
